The ToS state this:

n) You may not leave an Outspark Account logged into the Outspark Service while unattended via either a software applications or physical object(s). If your Outspark Game persona is performing an action of any kind, you must be able to respond to an Outspark representative if approached.

Question: What if you are in vendor mode while you sleep and a Gm tries to talk to me and I don't respond?

Does that mean I violating the ToS?

Question: What if I'm doing the Endurance titles, and I leave my character doing dance 5, Gm tries to talk to me I don't respond. I'm either at work or sleeping?

Does that mean I'm violationg the ToS?

If I understand this correctly.....Does that mean we might not be able to achieve endurance titles?

Or is it a Judgment call?

Presumably a judgement call on behalf of OutSpark. This is mostly to catch Spammers and Botters and not the average player who vendors over-night. So as long as you aren't doing anything illegal I doubt there will be an issue.

I just read the updated ToS and I have to say there were some quite interesting items in it.

means if your char is doing anything other then vending u must be there, afk doesnt count :)

Like said above, it means that if your character is performing actions such as farming, grinding, you must be able to respond.

standing still (or doing a dance/etc) in town or in the middle of nowhere doesn't count.

The key info there is "via either a software applications or physical object(s)." This means no bot programs and no sticking something in your keyboard to hold down a key(s) while you are away in order to perform an action.

Vendoring is ok.

Its not exactly our job to think too hard and interpret the ToS. Its just like some American laws... some of them get really weird, but are rarely/never enforced, or they have to be very technical. But its like the others have said, you can afk, you can vendor, but if your character is actually doing something, you have to be there to respond if a GM were to come up to you. Your character shouldn't be going anything anyways if you're not there O_O

I think of it as if you are preforming an action which requires you to respond to your surroundings, monsters, or thing to pick, you have to be the one doing it no using anything but your own hands to move about and kill or farm or what ever, as others said its to catch bots, vending, dance, standing, sitting that stuff isn't what they're talking about. I am unsure but it may also apply to shouting for titles (the ones that take hours to do) so they can check that you didn't just wright a 'script' i think its called and go play some playstation while the comp did your work shouting the same thing over and over and doing a count.

so no getting one of thoes heat sensitive birds with the mercury to hit the heal key on a cleric while you run off to the store.

I dont know if anyone remembers the simpsons where homer uses one for his work at home for the plant while off at a movie, but it was not his smartest idea

This is a good thing to introduce into the ToS, as bots and such are a big issue, so this resolves that nicely. I sometimes stop and say 'Hello? you there?' to people in DP1 as I pass through, and trust me, they're not always there...

I can see that making it very hard to play a new MMO.

"Uh. Mom. I'm stuck and I can;t ask for help cause you said not to talk to strangers." [/off topic]

I don't think a GM is gonna go walk up to a level 20 anyways that's vending and say.

"Are you there?"

"JAIL!"

The 'don't leave it on unattended' is, I think, more a rule to prevent accountsharing. Imagine you leave your computer on in the living room and go to the bathroom and someone else opens your fiesta and starts harassing ppl or steal all your stuff... it's accountsharing and not allowed so it is wise to not leave it unattended while other ppl can reach it.
That's what i thiought about that rule anyway.

Well i actually got approached by Dakkon once cuz he thought i was a lvl 71bot farmer in the mushrooms n herbs behind Trumpy Remains and at the time my keyboard shorted so i was using the online keyboard sign in n he asked me if i was able to reply and i was panicking thinking i was going to be banned/jailed but my last panicked action was to do dance 5 then dance 2 and do the hello action n he did a little "?" n i panicked til my gf at the time logged in and explained.. this game should support online keyboard T.T

If this happened your best bet is to probably do things a normal bot wouldn't be able to do. Like doing the emotes and maybe do trade/party requests.

LOL, that would suck if all of a sudden your keyboard doesn't work. These are good examples of what could happen and go wrong.

I think that the name also might give you a better idea if the player is a bot or not. Most bot names are random like jkjkjkjkjkjk8, unless someone wants to use a weird name like that.........

Well, seeing as it will come down to a judgment call if you can't reply.

What if your just standing there just dancing? I do that a lot to get titles...

I would think this only applies if your char is up about doing something. If it's moving around and farming or attacking monsters while you're afk, that's botting and a big no-no. If your char is in vendor mode, then it's fine. They just don't want you using 3rd party software or keyboard "tricks."

I'm pretty sure those things are judgment calls by the GMs. If it's an action that is impeding on another's gaming experience, they may take action. AFK dancing and etc. are harmless enough, so I don't think you'd get banned or in trouble for it. If anything, they'd probably come and check you out if you don't respond to them, just to see what you're doing. If they saw you dancing your butt off, they'd probably leave you alone.

As far as I'm aware, there's a timer on dances anyway. You stop dancing after about a half hour or hour or something. So after a while you'd just be standing there. Doing nothing.

I'm thinking that Outspark is more concerned about people who try to get an unfair advantage in levels or bot farmers. If you're not botting, I wouldn't worry about anything.
