It's against the rules, many people who spend some time on the forum know about this.
But a lot people don't use the forums much and are not aware of it.
When I open party matching I often see request to sell or buy sc items.
In towns I also hear people shouting they offer or want to buy a gift.
Sometimes I whisper them to tell them it's not allowed, and most of the time they say they didn't know.
So wouldn't it be helpfull to have a notice a few times in game to tell the players who don't use the forum that it's a TOS violation?

I thought gifting for in-game money was like enhancing for people... allowed to do it, but not allowed to advertise for it? If not, this is an example if why it should be announced in-game that it's not allowed, cuz you know how much time I spend on these forums... and I had no clue. O_O

Outspark's official stance regarding selling SparkCash gifts for in-game currency is no different than our stance regarding selling cash shop-aided item enhancements.
Players are not allowed to advertise gifting services to other players at any time. If you choose to accept the advertised offer and exchange in-game currency for a premium item gift, please understand that you do so at your own risk. Lost currency will not be refundable and Outspark support will be unable to assist you.
Remember, a gift should be exactly that - a gift.

Exchanging In-game money for cash shop items is not allowed. Hence why we do not allowed threads in the Marketplace that advertise the sales of Gifted items.
The CMs already made a couple of posts regarding this subject.
If you're caught doing this it'll land you in quite a bit of trouble.

Yesterday, I logged and immediately a guy, who I never saw before, whispered me to gift him a Perm Dragon Mount for silver.
However, to ask for gifts in not unlawful behavior. :/

Here’s the long and short of it: the ONLY TOS article I can find which may loosely be translated to fit this issue is:
h) You may not market, promote, advertise, or solicit (including multi-level marketing and chain letters) through the Outspark Service. This covers any type of virtual assets available on or through the Outspark Service as well as other online games and any real world items. Other than that DF001 has a valid point.
However, as CM_Saphar said,
Players are not allowed to advertise gifting services to other players at any time. If you choose to accept the advertised offer and exchange in-game currency for a premium item gift, please understand that you do so at your own risk. Lost currency will not be refundable and Outspark support will be unable to assist you.
My interpretation is this means it is not illegal, per se, but if any user chooses to take advantage of such a service and is then scammed, they are on their own; Outspark will simply not get involved. Now, take this with a grain of salt. My job, the that of all CLs, is not to interpret the TOS and we have no authority over in-game issues. Historically it has been OutSpark’s position to disallow the trading or selling of SC items. That was, however, before the introduction of the gifting system. IN other words, things are evolving constantly.
I hope this helps to demystify anything regarding this issue. Feel free to post additional questions here or PM a CL or CSR (via the new helper interface).

Outspark also does not allow this to simply reduce the amount of people getting scammed.
Players are not allowed at any time to request or offer gifting services for in-game currency, or real life currency at that. If you choose to accept these services, you do so at your own risk. And if you get scammed, Outspark is not responsible. Similar to Enhancement scams, you can report the person for offering the services..but you will not be reimbursed.

Throwing al the big words and confusing talk aside. It means advertising on forums is against ToS, you pay someone in game to gift you and they take your gold and log out your screwed, if you report nothing will happen.
And the more you people complain about people gifting for gold they'll take it away meaning no gifts for anyone and if you want to buy your girlfriend a wedding application because she cant use cs you'd have to charge her sc which is also against ToS.
So in short, suck it up, only way you can get them in trouble is if they take it to the forums, or a GM sees it in game i guess.

Does that part of the ToS apply to this case? I also wonder if we can still get reported if we are the ones that get asked for the services.

That may fall under
i) You may not directly or indirectly encourage, incite, or direct other Outspark Members to violate the Outspark Terms of Service, Rules of Conduct, or any applicable real world laws.
But that's a stretch.
