Bannable offenses?

Can someone direct me to where i can get a copy of the EULA for fiestaonline? im fairly confused as to what's bannable and what's not!
is there like a complete list or something?

For example, ill be honest; when i died, i character select then spawn on the same spot. most everyone i see does it, then this guys tells me that he took pictures and was gonna get me banned, is that true? how is relogging-in a bannable offense?! is it even in the EULA?

Kudos to the Outspark as i heard they are fast to act on complaints, but if im about to be summarily banned i'd like to know now before I invest any more time and money on the game.

Also i'd like to know if the following are bannable as some tell me:
1.Misvending the price of an item (is there a price cap or something?!)
2.Getting the announcer title
3.Killing People in mushrooms (guild war)
4.Killing People outside of town (guild war)
5.Declaring war vs KSers or leveling spot rivals
6.Any other offenses not clearly stated in the EULA

It's not totally EULA things. The Guild War articles can be answered by Dakkon's sticky above in this category. Pricing something above it's normal market price is not bannable, but advertising say, VIT[2] Production Skill Scroll, and selling a Vitality [2] Fighter Skill Scroll instead, is a scam, and is thereby bad.

Announcer title I dunno about at the moment, you may PM a GM and ask them about it.

I don't think getting the announcer title is bannable, well in my opinion it shouldn't be.

If people spam for the announcer title or any other sort of shouting title they can be reported for it.
The relog thing you spoke about, when you die, go to character select and come back. It's a bug, and exploiting any bugs can be bannable. Though most don't know it is and do it anyways. I think the Staff needs to make it even more public, make an announcement in-game about the relog bug that it is exploitation.

Shroom killing/Spawn killing/or declaring war on someone who has invaded your "spot" or has Ks'd you is considered a type of Harassment. Harassment is bannable.
Instead of warring KS'ers all you have to do is simply screenshot and report as harassment.

Impersonating a GM will get you banned faster than anything else in the game.
So you can add that to your list.

And the rest are all really at the GMs discretion.
Dakkon's rules pretty much supersede everything else.

how can you be banned for using the relog bug. if it was so bad it would have been fixed within a day. I gotta say, get over it. people will do it until its fixed and you cant stop them, announcing it or otherwise.

I know that some people post in stores that something is "2c ea!!" and then when you open the store, it's really like 2s ea, and if you buy a stack of that... that's 100s out the window. That's considered a scam... but there's no cap on the prices you can set... as long as people buy it, they know what they're paying for it... if you wanna make money, then I suggest keeping the prices low enough to sell things in the first place!

I know some of the others have touched on a couple of these items and I’d like to share some insight as well. What is/isn’t bannable falls into the realm of the GMs for the most part, depending on the severity of the infraction.

Things that can get you banned are (those in RED are more likely to get you banned):

Impersonating a GM or official member of the OutSpark staff at any time
Purchasing gold/silver from any one of the nefarious gold spammer sites (yes, they can track this)
Vulgar Harassment of any player at any time; the constant use of profanity or vulgar and/or lewd language
Constant spamming (for shout titles)
Abuse of the Guild War; warring for spawn territories, mobbing, revenge.
Intentionally pulling long trains of monsters toward another player with the intent to kill them, also known as “training”
Intentionally “scamming” another player*
Anything which violates the “spirit of the game”

* a vendor is allowed to set any price they wish at any time. If they wish to sell a lvl 1 sword at 1 gem, they can. Where this becomes a violation is, as Alden said, if they advertise one item for a price and attempt to sell another item instead. i.e. if they say they have Uruga scrolls for 10s, there had better be Uruga scrolls for 10s, not Rumen or Elderine, etc.

Some of these, if reported, may result in a warning, possibly jail time (character locked in an area with no escape for a set amount of time) or even a temporary ban but those in red will most certainly result in a ban.

The relog bug is actually an exploit and should not be used. By taking advantage of this you in essence are using it to move around the normal function of the game. It will be fixed soon, but can still be considered a reportable offense.

If you encounter anything you think is a violation, please capture as much information in a screenshot(s) as you can and forward them, with an explanation (including server, players involved, etc.) to a CL or GM for review. If a violation is found to exist, measures will be taken.

As far as obtaining the announcer title or the like, that itself is not punishable. Spam-yelling in an area can be, but the title itself isn’t. If you are interested in obtaining this title I encourage you to go somewhere where there is few, if any other people and try there. If anything, there is less of a chance of being reported for spamyelling.

Perhaps I missed something, but where is it stated that using the relog bug is a bannable offense? I don't see anything that relates in the ToS and I haven't heard/seen any GM mention it.

If they have, I'd be interested in taking a look, and perhaps having it stickied. I don't like the idea of people doing something in good faith just to be punished for it because they were ignorant of it being punishable in the first place.

Ok i made this post somewhere else as well when people were talking about something not being in the TOS, let me explain it for you here as well.

It's either # 13 or #14 in the TOS.

"Doing anything contrary to the spirit of the game"

What this means is, it is illegal to do anything that would give you an edge over how the game was designed. Meaning the game was not designed so that lvl 1's can farm in high level areas because they technically cannot die. It means that cleric's having the ability to rez someone was a class based talent and is now not needed because of the relog bug.

In short, anything that doesn't follow the game's design is illegal as it is not within the "Spirit of the Game"
