Dear Game Players,

When you downloaded this his game you probably had to a check a box saying that you agree to the Terms of Service before you could play this game. The, "Terms of service" contract that you agreed to is an extremely long lists of things that you may feel are not worth taking the time to read. In most cases such as down loading a typing program for personal use, the rules are quite obvious. Don't pirate, hack or modify the program. Reading the rules and agreeing to the Terms of service in many cases is a bit un-necessary because you know them already. However, the rules here in a live interactive game are not always so strait forward. I highly recommend reading the Terms of service for your self. This will remove all possibility of you falling a fowl of the law, so to speak. (Or will it?) There is so much legal jargon in that document that there is no way that just any one can understand it. Which brings me to the reason for writing this post and the reason is simple. If you break the rules you, even at level 79, which may take you as long as a few years to accomplish depending on how avid a gamer you are, you can be banned. What is banning you ask? It is the complete removal of your Character and the deletion of your account. Yep, it is nothing less that the loss of thousands of hours of your life. And over what? A misunderstanding of some rule that you may have broken a thousand times un-knowingly. And why did you misunderstand? Because of a Terms of Service contract that you agreed to months ago which reads like just about every legal document. (And you know that as soon as you saw the Terms of service contract you went, "Huh, What...OK I agree." and clicked the, "I Agree" box not even guessing the final result and not believing that something as simple as an off hand comment about how cute you thought some one was acting could lose you so much which, in most cases it wouldn't happen, but not in all cases.)

The Goal of this post: To get the facts strait!

It would be nice for me to say that I could tell you what the rules are in simple terms that every one can understand but in this case, I can't. Why, because I don't, can't and won't except responsibility for making a mistake and not deciphering the Terms of service for you correctly. SO! What is the solution? I am asking every one to ask those whose responsibility it is to provide us, the game players, with a real world explanation of the Terms of service. The practical applications of the Terms of service are not always obvious and, "word of mouth" communication of the rules is not reliable enough to catch every one. (I know because I am one of the ones who slipped through the cracks and fell all the way down to the bottom.) It is my greatest hope that, with enough support, the makers of this wonderful game will see the benefit of doing this and respond with some much needed positive clarity regarding the practical applications of the Terms of service.

I hope that you read this and see the benefit of such a thing. My intent isn't to make this a complaint forum. If you have been burned through a misunderstanding just let it go. Move on and consider posting a, "I think that this is a great idea" message to this Post. Please, do post your positive messages to this thread and remember how much fun you have had playing the game. The more positive input the better! Let us all help each other to make our gaming experience one that is free from un-intentional mistakes.

In the mean time, I say, "Have fun! Make friends! Enjoy your self! But, watch your step. If you have any doubts about doing or saying anything in the game or on the forum ask first and try to avoid miss steps and therefore the consequences there of."

Once again, please show your support for this idea for the benefit of every honest game player! And to those who break the rules on purpose I say, "Watch out! When honest people work together to help each other we can make a difference!"

Why don't you read the ToS and dumb it down for the rest of us? The GMs are always busy, and doing it would help out a bunch of people. Great idea Arch! The facts here are very true, yet it's someone besides the GMs that's going to have to translate it.

The TOS in a nutshell say this:

By creating an account with OutSpark you agree to:

Not attempt to manipulate or edit game files on your computer
Not use 3rd party programs to hack, cheat or modify the game in any way, including using bots, etc.
Will treat all other players with respect at all times; will not flame others, use vulgar language or attempt to harass players in any way at any time
Not post personal information about yourself in public forums or ask for the personal contact information of others on these forums
Not post vulgar or pornographic links or images. Period
Will obey the rules and regulations as set forth by OutSpark staff at all times
Not attempt to impersonate OutSpark staff in any manner at any time
Not do anything at any time which is not in the "spirit of the game"
Will use common sense when posting or playing that anything you say/so may be subject to report and punishment including infractions against your account and up to, but not limited to, a temporary or permanent ban against your account

Ok, the last one isn't in there, but it should be. :D

Although this is loose and everyone SHOULD take a moment to read the Terms of Service (http://www.outspark.com/legal) it covers most of the basics. However, any action which warrants a report or investigation for any reason may be subject to punishment.

It's so long and boring. You're condensed version says all she said, and more, in a much faster way.

Please, cut out things you don't need, as I doubt anyone (other than Serric) will actually have the patience/brain capacity to read it!

But you SHOULD read it... after all, anyone here is subject to punishment if found in violation of the TOS - ignorance of the rules is no excuse when breaking them.

Hate to sound harsh, but that is what it is. :D

Thanks Serric! Great post!

I realy think that you covered things well, however, I think I am looking for more of a "real world(game)" flavor. I know that before I started playing here I didn't even know what a, "Bot" was. Before I go on! THE PURCHAS OF SILVER THROUGH AN ONLINE STORE IS AN INSTANTLY BANNABLE OFFENSE! IT IS WRONG AND HURTS THE WHOLE GAME! IT IS A SERIOUS VIOLATION OF THE TERMS OF SERVICE AND YOU WILL BE BANNED IF YOU DO IT! NOW!

The thing that got me into trouble was the huge number of silver sellers in Roumen when I first joined. (This was before the big crack down on silver sellers.) I thought that the purchase of silver was a, "normal" part of the game because I had never played a MMorpg before. Buying silver doesn't reqire me to modify or do anything to the game or its programming yet it is considerd to be a serious violation of the ToS. *Disclaimer: DO NOT EVER PURCHASE SILVER AT ALL!
If you have Never played a MMorpg before or really any online games of this sort, (no one is gona bot a game of checkers on line. I mean, what in the heck would be the point?) you don't know the game lingo and you sure don't know where the game lingo intersects with the ToS.

What has become obvious to me now is well, obvious. But, I learned a ton of stuff that is in the ToS in a practical way by word of mouth. The first time some one told me to, "stop spamming, please!" I was like, "Spamming? Is't that an email thing? What do they mean?" So, I asked some one what was ment in the Game by, "spamming"? Shoot I didn't even know what "KS" ing was! I learned so much about the game by making mistakes and then appologising and then asking some one what I had done wrong. Any one of my first mistakes could have been considered a bannable offense. I once pulled a mob of monsters on me, "I knew about "KS" ing at this point" and when some one KS'd me for like the 5th or 6th time after asking them politely to stop, I stopped *pulling aggro (*another term I learned.) and let the mob of monsters I had pulled turn on the guy and kill him. Was this wrong? I am not sure? Simple lagg can cause the same situation and all I really did was stop fighting and just kept my self healed while I stood there. (The person never responded to my requests to stop KSing so maybe it was a bot?) I didn't even know what AOE ment until 4 days ago!

Here would be the best example of what I mean by, "Practicly explaining the ToS"

Does this make more sense? I hope so because I think that my brain is going to colapse from trying to remember all those game terms! (AAAHHHH!) and as in the example above, I don't know what, "flaming" is so it causes me to wonder if I have ever flamed some one or not? HELP! IF I HAVE please don't bann me again? I don't know what it is! PLEASE DEAR HEAVEN IF I HAVE FLAMED ANY ONE DON'T BANN ME BECAUSE I DON'T KNOW WHAT FLAMING IS! AS SOON AS I FIND OUT WHAT "FLAMING SOME ONE" MEANS I WILL MAKE SURE THAT I AM NOT DOING IT AND WILL NEVER DO IT AGAIN!

See what I mean Serric? I would love to have some one explain the game lingo to every one and show how the game lingo relates to the ToS as well as giving practical examples of "in Game" violations of the ToS to help us all better understand the ToS. Because, I am scared to death right now because of my ignorance. I could get banned from the game and my friends and ALL that wonderful fun just because I don't know! I desperately want to know and understand so that I never get banned from ignorance again. I lost so much because of my ignorance that I am determined to find the answers if I can. I could sure use the help of some one who knows the game lingo by heart and the game it self inside and out; to give the ToS some in depth game perspective by breaking it down *Rock Style. (*Rock Style, a term frequently used term by the military, Example: An explanations so simple that even the least intelegent person would be able to understand it.)

Okay… well, let’s see if I can shed some light on this for you.

Bot: a 3rd party program which runs scripts to allow a character to perform rudimentary functions in the game while the player is away doing other thing (work, sleep, etc.) – bots have two functions, really. 1: to grind in battle and gain experience/levels while the player is away and 2: to spam for illegal sites/services.

Spamming: to say something over and over again. This can either be saying the same thing over and over, posting gibberish or posting text in a repetitious manner over and over again and again and…. Also spamming could be posting your text in every place as much as possible to gain maximum coverage.

Gold Spammer(ing): usually a bot who spasm illegal sites to purchase silver/gold or power leveling services.

Flaming: to harass another poster/player with negative, insulting, offensive or lewd comments/text.

KillStealing (KSing): to attack a monster that someone else has already engaged in battle without receiving permission by the original attacker. There is debate on this, however, concerning whether or not this applies to monsters attacking the player but not being currently attacked BY the player (usually happens when a single player is faced with more than one monster at a time)

All of the above are punishable violations and, if repeated, bannable.
